Terms and Conditions – Purchasing an artwork online.


Acceptance of terms

silvialerin.com provides its service to you, subject to these terms.

We reserve the right to change and or amend these terms at any time by posting the amended terms on our site.

By using silvialerin.com you agree to be bound by these terms.

If you have any queries about purchasing an original or a print, or are unsure how the terms and conditions may apply to your order, please don't hesitate to contact me.

Purchasing

All purchases made from this website will be subject to these Terms. Purchasing from this website confirms your acceptance of these Terms.

All dimensions shown on this site are height by width by depth.

All prices displayed on silvialerin.com are in US Dollar ($). Buyer should check currency conversions on the day of purchase for an accurate price in their own currency.

At the present time there is no added VAT. Credit card details taken via the website are taken through PayPal’s secure payment gateway to help provide the safest way to shop on the internet, and because of this neither silvialerin.com nor the Artist has any access to customers’ credit/debit card details.

Before buying an artwork the cost of postage, packaging and shipping insurance will be added to the total price. This will be shown on your receipt, and is non-refundable if you should decide to return the work for any other reason except it being damaged.

Once having completed the purchase, if, for any reason you should decide to cancel the transaction after placing your order, you will be responsible for all postage costs for the initial shipment of the work, you will be also be responsible for the return condition, and cost of return shipping of the work. Upon return of the work to the artist, in identical condition to that in which it was originally sent, reimbursement will be made for the amount you paid less the aforementioned shipping fees.

Cancellations

If a customer wishes to cancel an order for any reason up until the time the artwork has been dispatched, a full refund will be made, minus any PayPal payment gateway transaction fees already incurred. This does not apply to goods bought in person offline.

If the order is cancelled after the goods have been dispatched the customer will be refunded the cost of the artwork, minus any transaction fees which have been incurred and also the shipping cost will not be refunded. The customer will be responsible for the cost of returning the artwork and ensuring its safety until it is received by the artist. It is advised to leave the artwork in the packaging it was sent in unless for some reason this is not possible, or the packaging is damaged.

Returns

A customer who has purchased an artwork from silvialerin.com has three working days from the date of receipt to decide if they are happy with the artwork. This does not apply to goods ordered or bought in person offline. If for any reason you decide not to keep the artwork you can return the artwork for a refund. This does not include the cost of shipping it to you. You are also responsible for the cost and the safe return of the artwork, which must be received by us in the same condition that it was at time of despatch from us, unless it has been reported as damaged (see below).

Damaged Goods

Artwork is posted with insurance, any goods which are received by the customer that are found to be damaged can be returned to the artist for a full refund. It is essential that you inform the artist within 48 hours of receipt of your artwork, in the case of a claim for damage.

It is the customer’s responsibility to check there is no discernable damage to the package before signing for the package, if your package is damaged on receipt you must mark the delivery note / receipt ‘Damaged’ and report the problem to us within 24hrs of delivery. If the delivery note / receipt has been signed in any other way you may waive all right to claim for any replacement for goods damaged in transit. Items which are collected in person should be checked before leaving the premises.

This website does not collect any personal information other than that entered by those purchasing products. Any information provided to purchase a product is solely used for that purpose and is not disclosed to any third party. Credit card details are only retained as required by the processing company to demonstrate approval for the transaction was provided by clients.

All images displayed on this website are copyright and the property of the artist. Any unauthorised use of images from this site, used either on or offline, is strictly prohibited and a violation of this copyright which will be pursued to the full extent of the law.


Terms and Conditions – Commissioning an artwork or an art intervention in a private/public space


I always prefer to talk to prospective clients about commissioned work although artwork can be commissioned by e-mail.

On receipt of a commission Silvia Lerin will provide you with a specification, an approximate timescale for delivery/execution and a price, which will include a price for delivery in the case of artworks commissions.

Please note that our artworks/interventions must be paid for in $ (US Dollar), therefore the price for a commission may change due to fluctuations in exchange rates if you are completing the transaction in another currency.

A deposit is required for all commissions which is non-refundable in case of ending of the commission. Work is not started on any artwork before a deposit is received. On paying your deposit you are entering into a contract with Silvia Lerin for the provision of an artwork/intervention agreeing to the specification provided by Silvia Lerin, and to pay the total price quoted at a date to be agreed. You are also agreeing to these terms and conditions.

Once a deposit is received, a charge may be applicable to change the specification of your artwork. While Silvia Lerin will always try and incorporated changes required by the customer, they may not always be possible once work on a piece has started.

Paying for your commissioned artwork

On completion of your artwork/intervention, you will be sent an invoice for the outstanding balance by e-mail which must be paid $ (US Dollar), within 5 working days.

On receipt of your final payment Silvia Lerin will make arrangements for the delivery of your artwork.

Returns and cancellations - commissioned items

Under your contract with Silvia Lerin the supply of goods (your artwork) is made specifically to meet your specifications and therefore your order cannot be cancelled after a deposit has been paid and a contract entered into.

In the highly unlikely event your commission does not match your specification or you believe there may be issues with the quality of the product, Silvia Lerin will endeavour to resolve the situation to your satisfaction as quickly as possible. Please contact her to explain your specific queries and agree a course of action.
